Terms of Use

These Terms govern your use of hashorn.com. By using the site you accept them. If you do not accept them, please stop using the site. They do not replace the master services agreement (MSA) or Statement of Work (SOW) for a paid engagement with Hashorn, which is always covered by a separate signed document.

1. Definitions

"Hashorn," "we," "our," "us" refer to the Hashorn company that operates this website. "Site" means hashorn.com and any sub-domain we operate. "Content" means the text, code, design, brand marks, illustrations, blog posts, and case studies we publish on the site. "Engagement" means paid professional services that Hashorn delivers to you under a separate signed Statement of Work. "You," "your" means the individual or organisation using the site.

2. Acceptance of these Terms

By visiting, browsing, or otherwise using the site, you confirm that you have read these Terms and agree to be bound by them, together with our Privacy Policy and Refund and Cancellation Policy. If you are using the site on behalf of an organisation, you confirm that you have authority to bind that organisation.

3. Who we are

Hashorn is a senior-only software engineering studio. We pair AI-augmented engineering, QA, MLOps, and security in one delivery unit. The site exists to explain what we do and to let you start a conversation with us. Hiring Hashorn for a project is a separate step covered by an MSA / SOW.

4. The site is not the engagement

These Terms cover your use of the site. They do not describe the scope, fees, deliverables, warranties, intellectual-property assignment, confidentiality, or liability caps that apply to a paid Hashorn engagement. Those are negotiated in writing and signed before work begins. Where these Terms conflict with a signed MSA / SOW for an engagement, the signed document wins.

5. Acceptable use of the site

You may use the site for personal and internal business purposes, subject to these rules:

  • Do not reverse engineer, scrape at scale, or attempt to extract our database.
  • Do not use the contact form or the chat assistant to send unsolicited commercial messages, malware, or anything illegal.
  • Do not impersonate another person or organisation.
  • Do not attempt to disrupt the site (rate-limit evasion, denial of service, automated attacks against the chat endpoint).
  • Do not use the chat assistant or any other surface to extract proprietary prompts, training data, or model behaviour beyond what is needed to ask a normal business question.

We may rate-limit, block, or pursue legal remedies against any user who breaks these rules.

6. Intellectual property

The site Content is owned by Hashorn or licensed to us. The "Hashorn" name and the H wordmark are trademarks of Hashorn. You may share links to our pages, quote short excerpts with attribution, and link to our case studies. Use beyond that requires written permission. Any open-source code we publish on GitHub is licensed under the licence stated in each repository.

Intellectual-property ownership and assignment for deliverables produced inside a paid engagement is governed by the relevant Statement of Work, not by these Terms.

7. Third-party links and integrations

The site links to and integrates with third-party services we do not control, including Cal.com (for bookings), Groq (the AI inference provider behind the chat assistant), Vercel (hosting), Resend (transactional email), and our profiles on LinkedIn, X, and GitHub. We are not responsible for the availability, accuracy, security, or content of those services, and their own terms apply when you use them.

8. Fees, payments, and refunds

Using the site itself is free. Paid Hashorn engagements (strategy audits, sprints, projects, retainers) are governed by the fees, billing schedule, and acceptance criteria in the relevant Statement of Work. Refunds and cancellations for those engagements are covered by our Refund and Cancellation Policy, which is part of these Terms by reference.

9. Termination of site access

We may suspend or terminate your access to the site at any time, with or without notice, if we reasonably believe you have breached these Terms or are using the site to harm us, our clients, or other visitors. Termination of site access does not by itself terminate any ongoing engagement, which is governed by its own agreement.

10. Disclaimers

The site is provided "as is" and "as available." Beyond what we say in writing under a separate Statement of Work, we make no warranties about the accuracy, fitness for a particular purpose, or uninterrupted availability of the site. Blog posts and service descriptions reflect our views and experience at the time of writing and are not professional advice for your specific situation. The chat assistant is an AI, not a human; it can make mistakes. Verify anything material with the team before acting on it.

11. Limitation of liability

To the maximum extent permitted by law, Hashorn is not liable for indirect, incidental, consequential, or punitive losses arising from your use of this website. Our total cumulative liability for any direct losses arising from your use of the site (excluding any paid engagement) is limited to one hundred US dollars (USD 100). Where local law forbids excluding certain liabilities (for example for fraud, gross negligence, or personal injury), those exclusions do not apply.

If you have hired us for an engagement, the limitation-of-liability terms in your Statement of Work (not this section) govern that engagement.

12. Privacy

Our Privacy Policy explains how we handle your personal information.

13. Changes

We may update these Terms. The "Last updated" date at the top will change. Continued use of the site after a change means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Subject to any applicable arbitration agreement in a signed Statement of Work, disputes arising out of your use of the site will be resolved by the competent courts located in India. Nothing in these Terms limits any mandatory consumer-protection rights you have under the law of the country where you live.
